New Mexico cannabis laws in plain English

What adults can buy, carry, grow and do with legal weed in New Mexico, written by the budtenders at a Clovis dispensary and checked against the state's own rules.

We get the same handful of questions at the counter every day. How much can I buy? Can my cousin from Lubbock come in? Can I smoke in the car out front? (No.) So here's our rundown of New Mexico cannabis laws, the way we'd explain them across the counter on W 7th St. Cannabis is legal for adults here, but "legal" comes with limits, and a few of them trip people up.

This is general information, not legal advice. Laws and tax rates change, so check the official sources at the bottom of this page if you need the exact wording.

Who can buy weed in New Mexico

Anyone 21 or older can walk into a licensed dispensary and buy. You don't need a medical card, you don't need to be a New Mexico resident, and you don't have to fill out an application. The state's own guide puts it simply: any individual over the age of 21 may purchase from a legal dispensary.

What you do need is a valid government-issued photo ID, and we check it every time, even if you look 50. If you're carrying something other than a regular driver's license or state ID, give us a call at (575) 935-4270 before you drive over so there are no surprises.

If you're 18, 19 or 20, adult-use is off the table. The only legal route at that age is New Mexico's Medical Cannabis Program, which has its own enrollment process.

How much cannabis you can buy and carry

New Mexico weed laws set three separate caps, and they apply both to a single purchase and to what you carry in public:

  • 2 ounces of cannabis (flower, pre-rolls)
  • 16 grams of concentrate (wax, shatter, live resin, rosin, and the oil in vape carts)
  • 800 milligrams of THC in edibles (gummies, chocolates, drinks)

Two ounces of flower is a lot. Most people buy an eighth or a quarter at a time, so you're unlikely to hit the ceiling by accident. The one people bump into is edibles: 800 mg sounds like plenty until you notice a single package can hold 100 mg or more. Our cart keeps a running count against all three limits, and so do we at the counter.

At home: storage, gifting and growing

No cap at home

The public limits don't follow you through your front door. You can keep more than 2 ounces at your residence as long as it isn't visible from a public place. We'd still lock it up, keep it out of sight, and keep it away from kids.

Gifting

You can give cannabis to another adult 21 or older, within the possession limits, as long as nothing changes hands. No cash, no trade, no "you get gas money and I'll bring an eighth." Once something is exchanged, it's a sale, and selling without a license is not legal.

Growing your own

Adults 21 and older can grow up to six mature plants and six seedlings, with a household max of 12 mature plants. If you rent, check your lease before you plant anything.

Pipes, bongs and papers

Owning pipes, bongs and other paraphernalia carries no penalty under New Mexico law, which is why our smoke shop sits under the same roof as our dispensary. If you're shopping for a first piece, our bong vs dab rig guide breaks down what's what.

Where you can and can’t smoke

Here's the one that gets people: legal to buy does not mean legal to light up anywhere. Public use is prohibited, and smoking cannabis in public carries a $50 fine. That covers sidewalks, parks, parking lots, and streets and highways.

So where can you? Private property, with the owner's OK. A few things to keep in mind:

  • Renting? Read your lease. Landlords and property managers can have their own smoking rules.
  • Staying at a hotel? Most are non-smoking, and some ban cannabis outright. Ask before you check in.
  • Consumption lounges are allowed under state law as a licensed type of business, but cities and counties can say no to them. Unless a place is licensed for it, assume it isn't allowed.
  • Around kids: don't use around them, and store everything where they can't get to it.

Driving and the ride home

Don't drive high. It's illegal to operate a vehicle under the influence of cannabis in New Mexico, same as alcohol. And because streets and highways count as public places, you can't consume in a car at all, whether you're driving, riding shotgun or parked.

For the trip home from the shop, keep your purchase in its original sealed packaging. We'd add: put the bag in the trunk or behind the back seat, not in the cupholder.

Crossing state lines: keep it in New Mexico

Clovis is about ten miles from the Texas line, so we hear this one a lot. The answer is no. Cannabis bought in New Mexico has to stay in New Mexico. The state's rule is that purchases must be intrastate, and moving cannabis across any state line breaks federal law. In Texas, possessing it is illegal, full stop.

Visitors from Hereford, Muleshoe, Lubbock and anywhere else are welcome to shop with us. Just plan to enjoy it in New Mexico, on private property, and don't take any of it with you when you head back east. Our guide for Texas visitors covers the details.

Medical cannabis program basics

New Mexico still runs a separate Medical Cannabis Program alongside adult-use. The big differences:

  • Age: patients 18 to 20 can enroll and buy through the program, even though adult-use is 21+.
  • Amounts: enrolled patients can buy up to 425 units (about 15 ounces) in any 90-day period.
  • Taxes: medical purchases within that limit are not taxed. Past the limit, extra purchases go through adult-use and get taxed.
  • Out-of-state cards: New Mexico has reciprocity. A visiting patient registers at the dispensary, and the product has to come from an in-state source.

Enrollment is handled by the state, not by dispensaries. If you're a patient, bring your card and ask at the counter how medical purchases are handled here.

Cannabis taxes in New Mexico

Every adult-use purchase carries two taxes. The first is the state cannabis excise tax, which is 14% from July 1, 2026 through June 30, 2027. It's set to climb one point each July 1: 15% in 2027, 16% in 2028, 17% in 2029 and 18% starting July 1, 2030. The excise rate is the same everywhere in the state.

The second is gross receipts tax, New Mexico's version of sales tax, charged at the local rate on top of the excise tax. The shelf price on our menu is before tax, and your total at pickup shows both.

Questions people ask
